Introduction to Intellectual Property: Crash Course IP 1

10:10
This week, Stan Muller launches the Crash Course Intellectual Property mini-series. So, what is intellectual property, and why are we teaching it? Well, intellectual property is about ideas and their ownership, and it's basically about the rights of creators to make money from their work. Intellectual property is so pervasive in today's world, we thought you ought to know a little bit about it. We're going to discuss the three major elements of IP: Copyright, Patents, and Trademarks. Protecting intellectual property in China

07:28
Increasingly, China is just as afraid of its intellectual property being stolen as are foreign companies. Use different strategies, trademark your brand -- don't use fear of IP being copied as a reason not to go to China.

What is Intellectual Property

03:10
Intellectual Property (IP) includes Patents, Trade Marks, Designs and Copyright. IP allows you to own, control and be awarded for your ideas. The 4 main types of IP are; Patents for inventions, Trademarks for brand identity, Designs for the visual appearance of a product and Copyright for the expression of an idea.
Trademark Explained - Intellectual Property Law | Lex Animata | Hesham Elrafei

02:21
What is Trademark law? By Hesham Elrafei https://www.linkedin.com/in/heshamelrafei Trademarks are brand names or designs , which are applied to products and services. A trademark is a distinguished word, phrase , a symbol , a fragrance or a logo , or a combination of these elements. which is used in trade/business , to indicate the origin/source of the brand, in order to distinguish and identify the brand owner in the market. Trademark law protects the consumer, by preventing the public confusion , as to the origin or quality of a product. and it also reward the brand owner , by maintaining his business successful reputation in the market. Trademarks legally conflict with each other, if the use of one trademark causes public confusion as to the product being offered in the market ( likelihood of confusion ) The american law protects trademarks even if its not registered, which is also known as the Common Law Trademark Rights, in this case registration is not required to establish trademark rights, seeing that the first who use a trademark in commerce owns it. On the other hand, Most countries require registration of a trademark , as it provides legal certainty and reinforces the position of the right holder . therefore any subsequent users who cause confusion as to the product or its origin , will be forced to stop using the mark , and might be liable to pay the trademark owner damages. Lastly, Trademark is not absolute as its subject to various limits and defenses, such as abandonment, limitations on geographic area in which the mark is used , and fair use , which means that the more common and generic the word is , the less likely the trademark owner may be able to regulate it. This doctrine also protects "nominative" use of the trademark name, as is often done by competitors in marketing materials.

Trademarks and Avoiding Consumer Confusion: Crash Course Intellectual Property #5

11:20
In which Stan Muller teaches you about our third branch of Intellectual Property, trademarks. A lot of people confuse trademark and copyright. Trademarks apply to things like company and product names and logos, packaging designs, and commercial designs. Basically, copyright protects ideas, but trademarks protect the things that help consumers tell companies apart. This ensures that consumers know the source of the goods they're buying. Without trademarks, it would be really difficult to buy the same product twice, and very easy for unscrupulous companies to pass off fakes and knock offs of the products you want. I'm telling you, you like trademarks. Crash Course is now on Patreon! Intellectual Property Crash Course: Beyond Patents

47:00
Patents are not the only form of intellectual property available to entrepreneurs. Copyright protects the source code behind a software-implemented invention, companies like Apple are increasingly using design patents, and trademark law offers some initial protection for the brand recognition that comes from the “first mover advantage.” In this week’s hangout, we’ll cover the other forms of intellectual property that can supplement patent protection in rounding out a startup’s intellectual property strategy and providing a competitive advantage in the absence of patents.
Intellectual Property: Licensing

10:09
Peter McDermott hopes you’ll spend more time on licensing than litigation. However, it is important that you know what success looks like from a business, technology, and legal perspective. How to Protect Your Agency’s Brand Assets & Intellectual Property

25:33
How can you protect yourself and your clients from brand copycats? I recently had some major issues with a copycat and had to take action FAST in order to protect my business and brand. In this episode, learn what you can do to proactively defend your agency and clients’ intellectual property. In this episode, we’ll cover: What is and what isn’t intellectual property? Why register your agency’s brand assets? Tools and tips to keep your assets protected. Today’s guest is Cheryl Hodgson, founder of Hodgson Legal and BrandAide.com. She’s an attorney, advisor, author and expert on everything related to brand protection. She specializes in intellectual property and brand assets. And, she shares advice protecting your and your clients' brand assets. Cheryl touches on everything from copyrights and trademarks to goods/service names and domain names. What Is and What Isn’t Intellectual Property? Cheryl says the term “Intellectual Property” is often misunderstood. Legally, this term only applies to assets in five specific areas: Brand Names: This is one of the most important assets a business owns. It’s a unique identifier with a long life and requires protection. Cheryl says most businesses don’t put enough time into developing names - they settle on it with little thought. When developing names, Cheryl advises seeing what’s already out there to avoid conflicts. Copyright: Any artistic expression of an idea is copyright protectable and includes things such as programs and content. Without the registering you have rights but no remedy. Patents: Things like inventions and software are patentable. Patents are exclusive rights granted for a product or a process that provides a new way of doing something or offers a new technical solution to a problem. Confidential Information: Any private or classified business information can be intellectual property - things like lists, non-disclosure agreements, confidentiality agreements, etc. that should not be shared without your permission. Domain Names: In most cases, a web address is more important than a physical address. Domain names are business assets and need protection. Why Register Your Agency’s Brand Assets? The biggest reason to register is because it adds value to your agency. No matter whether you’re considering selling in the near future or the long distant future, owning your intellectual property increases your agency’s value. That’s what buyers care about most - sales, revenue and assets. Another great reason to register is to protect your turf. Cheryl shared a story about a former client who failed to register his brand and lost out big time! He started AmazonNetworks.com back in the early 90’s on the cusp of the internet boom. A short time later, a business named Amazon Book Sellers was founded. Initially there was no conflict but as Amazon Book Sellers grew they decided to register their brand. As you can imagine, AmazonNetworks.com was eventually sued and forced out of business. [clickToTweet tweet="Why register your brand and services? Without a trademark, your brand identity becomes diluted." quote="Why register your brand and services? Without a trademark, your brand identity becomes diluted."] Tools and Tips to Protect Your Agency Your brand assets and intellectual property are your unique identifiers. When it becomes popular the value becomes diluted and it no longer distinguishes your goods or services from others. Registering and monitoring use of your brand names protects your brand’s identity. When naming goods or services, do your due diligence to see what else is already out there: Search the United States Patent and Trademark Office database and find what is already registered. Monitor Google Alerts with brand/product names or terms specific to your brand. If you discover a copycat (like I did) of your registered assets, there’s a few different courses of action you can consider: Simple, careless plagiarism can start with a direct phone call or email to the offender. Blatantly egregious or fraudulent activity should be handled with a letter from an attorney. Can You Force Someone to Release a Domain Name? This is always a tricky topic. Cheryl says a domain name on it’s own is just like your street address... If someone is parked on it with no commercial use there’s nothing you can do about it. However if someone is using a name you own for commercial use, you do have rights and protection. Likewise if you have a successful product or service, competitors or related businesses will try to duplicate what you’re doing by using a similar domain name with a different extension (.net, .org, etc.) A Domain Dispute Resolution is a cost effective way to recapture your rights and avoid expensive court proceedings. Cheryl suggests speaking to a law professional or checking out the National Arbitration Forum or WIPO.

5 Movies with Unbelievable Scenes about Trademarks & Intellectual Property | Trademark Factory® FAQ

16:55
5 Movies with Unbelievable Scenes about Trademarks and Intellectual Property Secure Your Brand with Trademark Factory® Risk-Free, Guaranteed. https://www.trademarkfactory.com Before I get into my list, here's a quick disclaimer: I don't own the rights to these five movies. I'm only showing them for educational purposes and for illustrational purposes, really. If you like those movies as I do, get the whole thing, make sure that you own your own copy and watch them. They're amazing movies. Number five in my list is Silicon Valley. This is the scene you never want to find yourself in. This is when you realize you have to go to court and lawyer up to protect your intellectual property. Number four in my list is Social Network. It shows several things. Really, it shows the value of IP. It also shows that worse fights always come as a result of best friendships and it also shows how important it is to properly document everything around who came up with what first and what the mutual expectations are. Number three in my list is The People Versus Larry Flint. I don't want to spoil this for you. Let me just say that it's a scene where Larry came up with an unconventional way of dealing with allegations of defamation and libel made against him. Number two in my list is Flash of Genius. The whole movie is brilliant, and the whole movie's about IP. The scenes that I picked, and what you're gonna see is a few scenes merge into one, show that intellectual property is not just about the money, and it shows you how much people suffer when they see what they've poured their heart and soul into stolen by others. The top of the list is The Founder. A really powerful scene that shows how important the brand is and also how important it is to properly protect the brand. ----------------------------------- Trademark Factory® resources: ★ Website: https://trademarkfactory.com ★ ☆ YouTube Channel: https://youtube.com/trademarkfactory.com ☆ ★ Facebook Page: https://facebook.com/thetrademarkfactory ★ ☆ Twitter: https://twitter.com/realTMfactory ☆ ★ Kick-Ass Brands Show: http://kickassbrandsshow.com ★ ☆ Kick-Ass Brands Facebook Group: https://www.facebook.com/groups/kickassbrands ☆

Legally Branded: Brand Law: Logos, Trade Marks, Designs, Copyight & Intellectual Property Audiobook

03:07
Listen to this audiobook in full for free with a 30-day trial: https://www.audiobooks.com/bookforfree/158371 A common mistake business owners and branding professionals make when creating new brands, is to fail to consult a lawyer early enough. As a result they risk choosing names which infringe on the rights of others or are inadequate. By the time they discover this they have invested too much time and energy in the brand to want to change it. In these competitive times it's important to learn how to avoid such mistakes. If your marketing team find ways to help your business stand out, it's essential to protect the branding element that truly set your business or product apart from the competition. That's how the likes of Coca-Cola have secured ownership of their iconic bottle shape and retained their distinctiveness. Legally Branded is an accessible guide, written by an experienced lawyer. If you aspire to create a successful business without necessarily wanting to become the next Coca Cola, attend to intellectual property issues as this is how you create assets and increase the value of the business. Also, if you want to avoid infringing on the rights of others, and to get things right from the start, you will find this book to be essential reading. Contact: [email protected]

Check out our other videos here http://vid.io/xq4z The most important thing a seller needs to know about IP complaints is to immediately address any complaint you receive. Don't let it linger on your account; they do not go away by themselves. A seller needs to get an appeal or reach out to the rights owner for a retraction so that your account does not get / remain suspended. One of the biggest problems that sellers face is that they reach out to the rights owner or brand and get no response. Using an experienced law firm such as Rosenbaum Famularo, PC, the firm behind AmazonSellersLawyer.com is helpful; lawyers tend to get better results from the complainant than the seller. You never know when Amazon will finally suspend your account for IP complaints; larger accounts can withstand more complaints than smaller accounts, but there really is no specific number of complaints required for IP suspension. If a brand does not respond or refuses to withdraw their IP complaint, you can reach out directly to Amazon at [email protected] and create a Plan of Action letting them know that you have unsuccessfully tried to contact the complainant; therefore can they please help you resolve the issues on your account. A Digital Millenium Copyright Act (DMCA) counter notice can be used when there is a baseless copyright complaint made against a seller. It gives them the ability to tell the brand that they either have to sue or drop their complaint. Legally Branded: Brand Law: Logos, Trade Marks, Designs, Copyight & Intellectual Property Audiobook

03:07
A common mistake business owners and branding professionals make when creating new brands, is to fail to consult a lawyer early enough.

Brand Licensing Intellectual Property Meeting - Los Angeles

Brand Licensing Intellectual Property Meeting - Los Angeles Today I went up to Los Angeles and attended a meeting with some Branding Licensing and Intellectual Property Professions. The meeting was at the Nelson Hardiman office. http://www.nelsonhardiman.com/ There were a number of trademark attorney, licensing attorney, patent attorneys, marketing/branding and licensing experts. Great take away from the meeting was an update on the Amazon "Gating" program which allows brand owners to block the sale of their genuine products on the Amazon Marketplace. Here are some relevant articles on the Gating Program. https://sellercentral.amazon.com/forums/thread.jspa?threadID=318073 http://www.helium10.com/blog/selling-on-amazon/brand-gating-stop-sellers-permanently/ Link to the video: https://youtu.be/Tkc2TMjnJWg ++++++ Risk Mitigation TV And now a little bit of background on me. I have been an investigative consultant to businesses and legal counsel for over 15 years. I am a license private investigator in the state of California and have testified as an expert in case involving Workers Comp, Counterfeiting and a variety of other civil cases. I own and operate my own Investigative Consulting business here in California and I enjoy speaking to businesses and law firms about current trends in litigation, technology and investigative strategy. I believe that businesses must implement certain strategies to mitigate exposure to Embezzlement, Fraud, Workers Comp Claims, Trade Secrets theft and many other employment related claims. Intellectual Property Law for Amazon Sellers

11:20
Check out our other videos here http://vid.io/xq4z Basic trademark law for Amazon sellers in the United States: A trademark is a name, logo, word that identifies a brand. Basically, when you see the Nike check mark or the 'M' for McDonald's on any product you know exactly what company that is and what kind of products they sell. The legal standard for when someone is infringing is when there is consumer confusion as to what product or brand we are buying. The application for a trademark is relatively easy to fill out, we help clients do it all the time. You do it online at USPTO.gov - that is the United States Patent and Trademark Office. You fill in, space by space, about the trademark you are trying to register. It is relatively inexpensive and does not take much of time to complete. If a seller tries to do it themselves and there is a problem, they receive an 'office action', a notice to respond. An office action does slow down the process, but not remarkable so. It takes anywhere from 6 months to 1 year to get a trademark approved. At Rosenbaum Famularo, the law firm behind AmazonSellersLawyer.com, we believe in teaching Amazon sellers to do things themselves, but are always here to help. Copyright law pertains to images, or pictures, and verbiage. You do not have to file for anything. When you take pictures of products yourself and post them on Amazon, you are protected by copyright. Amazon grants you the perpetual license to join listings, so you are not violating any type of copyright law. If you take someone else's pictures from another website and create a listing, then you are violating copyright law. Copyright is all about the creative process, so as soon as you create it, you own it. The ability to enforce it in court may depend on whether or not you actually file with the copyright office, but in terms of you owning & using it, you are protected. Patent law is a bit more complex. There are two different types of patent law: Design and utility. Design patents protect the appearance of a product. A utility patent protects the function of a product. Patents are good for twenty years and then expire. Design patents are easier to maintain. Trade dress has to do with the look, feel, color, shape, texture and packaging of a product. It never expires and does not have to be filed. First Sale Doctrine only exists in the United States; it does not apply in Europe. It states that you can buy and sell anything you want without the manufacturer's permission, but when you resell it to a consumer, it cannot have any material differences in what the consumer receives. There are many exceptions to this. Some things that make a product materially different are warrantees, exclusive packaging, and lack of quality controls.
