For instance, they can give you a blank inauthentic suspension, not letting you know what the exact problem is. If you are suffering from this type of suspension, our team has some tips for you. The notification itself gives you a lot of evidence of what Amazon's looking for. They are looking for invoices and proof of authorization from the brand owner. A lot of times, sellers don't have prior approval from Amazon or authorization from the brand owner. We look at the seller's account to see if there were orders placed. Sometimes there aren't any placed, so what we have to do is prove there was a valid supply chain. Often times when you're a small seller or even a medium seller, you may buy your products and just have invoices and receipts as proof of purchase. We advise you to go through the supply chain where you show that these products are authentic and the retailer/manufacturer you bought the item(s) from. If the seller has the receipts from the purchases, we then can use them to track the order. We use the research from wherever you are sourcing your product from and then we track that source all the way back to the manufacturer with documentation. A lot of this information we can obtain online. Tips for Amazon Sellers If you are a seller moving within Amazon's system, we recommend you do your due diligence to prevent a suspension before it happens. It is also a good idea to apply for a selling application, for a certain brand will allow you to list all the products that are under that brand. How we draft plans of action: Plans of action are nothing more than an exercise in persuasive writing. If you are putting together your plan of action, the goal is to persuade whomever you are addressing the letter to, whether it's in the United States or out of the country. We recommend that you back up the Plan of Action with documents showing that they are in fact, genuine products. You should further do the research by backing up the source of your goods back to the manufacturer to again show that it is a genuine and reliable product. How to Protect Your Agency’s Brand Assets & Intellectual Property

How can you protect yourself and your clients from brand copycats? I recently had some major issues with a copycat and had to take action FAST in order to protect my business and brand. In this episode, learn what you can do to proactively defend your agency and clients’ intellectual property. In this episode, we’ll cover: What is and what isn’t intellectual property? Why register your agency’s brand assets? Tools and tips to keep your assets protected. Today’s guest is Cheryl Hodgson, founder of Hodgson Legal and BrandAide.com. She’s an attorney, advisor, author and expert on everything related to brand protection. She specializes in intellectual property and brand assets. And, she shares advice protecting your and your clients' brand assets. Cheryl touches on everything from copyrights and trademarks to goods/service names and domain names. What Is and What Isn’t Intellectual Property? Cheryl says the term “Intellectual Property” is often misunderstood. Legally, this term only applies to assets in five specific areas: Brand Names: This is one of the most important assets a business owns. It’s a unique identifier with a long life and requires protection. Cheryl says most businesses don’t put enough time into developing names - they settle on it with little thought. When developing names, Cheryl advises seeing what’s already out there to avoid conflicts. Copyright: Any artistic expression of an idea is copyright protectable and includes things such as programs and content. Without the registering you have rights but no remedy. Patents: Things like inventions and software are patentable. Patents are exclusive rights granted for a product or a process that provides a new way of doing something or offers a new technical solution to a problem. Confidential Information: Any private or classified business information can be intellectual property - things like lists, non-disclosure agreements, confidentiality agreements, etc. that should not be shared without your permission. Domain Names: In most cases, a web address is more important than a physical address. Domain names are business assets and need protection. Why Register Your Agency’s Brand Assets? The biggest reason to register is because it adds value to your agency. No matter whether you’re considering selling in the near future or the long distant future, owning your intellectual property increases your agency’s value. That’s what buyers care about most - sales, revenue and assets. Another great reason to register is to protect your turf. Cheryl shared a story about a former client who failed to register his brand and lost out big time! He started AmazonNetworks.com back in the early 90’s on the cusp of the internet boom. A short time later, a business named Amazon Book Sellers was founded. Initially there was no conflict but as Amazon Book Sellers grew they decided to register their brand. As you can imagine, AmazonNetworks.com was eventually sued and forced out of business. [clickToTweet tweet="Why register your brand and services? Without a trademark, your brand identity becomes diluted."] Tools and Tips to Protect Your Agency Your brand assets and intellectual property are your unique identifiers. When it becomes popular the value becomes diluted and it no longer distinguishes your goods or services from others. Registering and monitoring use of your brand names protects your brand’s identity. When naming goods or services, do your due diligence to see what else is already out there: Search the United States Patent and Trademark Office database and find what is already registered. Monitor Google Alerts with brand/product names or terms specific to your brand. If you discover a copycat (like I did) of your registered assets, there’s a few different courses of action you can consider: Simple, careless plagiarism can start with a direct phone call or email to the offender. Blatantly egregious or fraudulent activity should be handled with a letter from an attorney. Can You Force Someone to Release a Domain Name? This is always a tricky topic. Cheryl says a domain name on it’s own is just like your street address... If someone is parked on it with no commercial use there’s nothing you can do about it. However if someone is using a name you own for commercial use, you do have rights and protection. Likewise if you have a successful product or service, competitors or related businesses will try to duplicate what you’re doing by using a similar domain name with a different extension (.net, .org, etc.) A Domain Dispute Resolution is a cost effective way to recapture your rights and avoid expensive court proceedings. Cheryl suggests speaking to a law professional or checking out the National Arbitration Forum or WIPO.

A trademark is a distinguished word, phrase , a symbol , a fragrance or a logo , or a combination of these elements. which is used in trade/business , to indicate the origin/source of the brand, in order to distinguish and identify the brand owner in the market. Trademark law protects the consumer, by preventing the public confusion , as to the origin or quality of a product. and it also reward the brand owner , by maintaining his business successful reputation in the market. Trademarks legally conflict with each other, if the use of one trademark causes public confusion as to the product being offered in the market ( likelihood of confusion ) The american law protects trademarks even if its not registered, which is also known as the Common Law Trademark Rights, in this case registration is not required to establish trademark rights, seeing that the first who use a trademark in commerce owns it. On the other hand, Most countries require registration of a trademark , as it provides legal certainty and reinforces the position of the right holder . therefore any subsequent users who cause confusion as to the product or its origin , will be forced to stop using the mark , and might be liable to pay the trademark owner damages. Lastly, Trademark is not absolute as its subject to various limits and defenses, such as abandonment, limitations on geographic area in which the mark is used , and fair use , which means that the more common and generic the word is , the less likely the trademark owner may be able to regulate it. This doctrine also protects "nominative" use of the trademark name, as is often done by competitors in marketing materials.

Tom Meyer, the company's General Manager in China, was not discouraged though and participated in a seminar organised by the China IPR SME Helpdesk, which helped him to understand what he should do." "We started registering our logo, our name, the copyright for the hardware, and the copyright for the software," he said. Tom finally managed to get rid of around 95 percent of the copies. And now works profitably and with peace of mind. "We probably invested the equivalent of 3,500 US dollars (2,700 euros) and our return on investment, I would say, was increase of revenue by 20 or 25 percent." For more on the protection on Intellectual Property Rights (IPR) in China, we look to the European Chamber of Commerce in Shanghai. The China IPR SME Helpdesk is a project set up by the European Commission. It aims to provide advice and information about intellectual property rights for European SMEs who settle in China. All services are free and available in six European languages ​​plus Chinese. There is no technical or legal jargon, just simple and useful information. Each year, the organisation advises around 500 SMEs directly and gives information to some 3,000 more. Naomi Saunders, the Project Manager for the Helpdesk said: "European SMEs really need to apply for their trademarks in China even before they arrive on the ground here, in order to protect (themselves). Basically, if you don't register it, somebody else will." In China it's the first to register a trademark has the right to it, a trademark registered in Europe is not protected in China. It is therefore necessary to re-register on site. He is an attorney located in Atlanta, Georgia at his own firm, Atlanta Law IP and has been practicing for over a decade. If an idea stays in your head, it is just an idea. If you convert an idea into a song, a product, a design or a book then it becomes intellectual property. Now the idea has value and may need protecting. Protection can come in the form of a patent, copyright or trade mark. This protection is an incentive to firms to go on and produce the product. Patents protect the working parts of a product, what they do, how they do it, what they are made of and how they are made. A patent gives inventors control over their invention for twenty years. This can stop other would be manufacturers from making a similar product using their ideas. A patent gives firms a competitive advantage, they can establish their product in the market without any competition and charge higher prices which helps to recover their research costs. They could also sell the rights to the invention, or licence the invention to another manufacturer. Copyright laws protect the image of the product. The reason a business would want to protect images of their product is to ensure they are only used in situations that benefit the product and brand. Finally the name and company logo are protected by trademark. This is done by registering the product name or symbol with the intellectual property office. Business names and logos are valuable trademarks because they are a sign which distinguishes a firms products from its competitors.

Basically, when you see the Nike check mark or the 'M' for McDonald's on any product you know exactly what company that is and what kind of products they sell. The legal standard for when someone is infringing is when there is consumer confusion as to what product or brand we are buying. The application for a trademark is relatively easy to fill out, we help clients do it all the time. You do it online at USPTO.gov - that is the United States Patent and Trademark Office. You fill in, space by space, about the trademark you are trying to register. It is relatively inexpensive and does not take much of time to complete. If a seller tries to do it themselves and there is a problem, they receive an 'office action', a notice to respond. An office action does slow down the process, but not remarkable so. It takes anywhere from 6 months to 1 year to get a trademark approved. At Rosenbaum Famularo, the law firm behind AmazonSellersLawyer.com, we believe in teaching Amazon sellers to do things themselves, but are always here to help. Copyright law pertains to images, or pictures, and verbiage. You do not have to file for anything. When you take pictures of products yourself and post them on Amazon, you are protected by copyright. Amazon grants you the perpetual license to join listings, so you are not violating any type of copyright law. If you take someone else's pictures from another website and create a listing, then you are violating copyright law. Copyright is all about the creative process, so as soon as you create it, you own it. The ability to enforce it in court may depend on whether or not you actually file with the copyright office, but in terms of you owning & using it, you are protected. Patent law is a bit more complex. There are two different types of patent law: Design and utility. Design patents protect the appearance of a product. A utility patent protects the function of a product. Patents are good for twenty years and then expire. Design patents are easier to maintain. Trade dress has to do with the look, feel, color, shape, texture and packaging of a product. It never expires and does not have to be filed. First Sale Doctrine only exists in the United States; it does not apply in Europe. It states that you can buy and sell anything you want without the manufacturer's permission, but when you resell it to a consumer, it cannot have any material differences in what the consumer receives. There are many exceptions to this. Some things that make a product materially different are warrantees, exclusive packaging, and lack of quality controls. How to Clear Your Amazon Account of Intellectual Property Complaints

Intellectual Property Complaints, also known as Rights Owner Complaints, can accumulate on a seller’s account. In general, if you have an IP complaint on your account but you did not get a listing suspension, keep in mind that refraining from selling a product will not resolve the issue. That IP complaint will remain against your account, and when those complaints begin to accumulate, your account will get suspended. A seller should always address each complaint immediately. You should contact the rights owner, either on your own, or through a law firm like Rosenbaum Famularo, PC. In order to properly address an IP complaint, you need to know and understand Intellectual Property law. Most people sending Intellectual Property complaints are simply doing their job; always remember to be respectful when responding to them. Let them know that you are taking their complaint seriously and that you will be in touch. The next step is to analyze the complaint to see if you have actually violated someone’s Intellectual Property rights, or if the complaint is baseless. Oftentimes, IP complaints are sent out in waves and can occasionally be filed in error. When writing a response to the complaint, you should always address all 4 categories of IP issues: trademark, patent, trade dress and patent. Your response should explain why you are not in violation of any of these categories and you should request a retraction of the complaint. Brands usually do not respond to individuals, so this is where hiring an attorney who is familiar with IP law is extremely beneficial. A seller should also contact Amazon directly; we appeal the complaint with Amazon’s Notice Dispute Department. Trademark complaints are usually baseless because you are selling genuine products and protected under The First Sale Doctrine. If the person making the complaint is outside of the United States, you can serve a counter notice under the Digital Millennium Copyright Act (DMCA) and tell the complainant that they can either start a lawsuit against you (most likely they will not) or withdraw the complaint. Every brand has its own distinct ‘identity’ and ‘promise’. It’s due to this promise that we know to expect something completely different if we buy a Rolex watch rather than a Swatch.  You will need to think through how you want your business to be known. What quality or outcome will you want to deliver consistently and reliably? How will customers know what to expect if they use your product or service so that there’s little risk of an unpleasant surprise? Buying a product or service from a business whose brand is not yet known is risky because it represents something untried and untested.  Once a business becomes a recognised brand in its marketplace, it can command a price premium or a market premium. People are willing to pay a premium to receive the expected results the brand is known for delivering. I suggest you think of Intellectual Property as something you need to address in your business because it’s the FIRST consideration any business needs to be mindful of when starting up or developing your ideas. Contrary to popular belief Intellectual Property (“IP”) isn’t just something you deal with once you’ve succeeded and gained traction. They were selling Netgear brand electronics and had their account shut down by an intellectual property rights complaint. This seller had their Amazon France account suspended due to trademark complaints filed by Netgear. They had quite a few ASINs that received reports of trademark infringement; trademarks generally refer to the brand's logo. Amazon Lawyer Tip: Never hire a non-lawyer to address an IP complaint. The seller reached out to us to help resolve the issue. After reviewing the file, we called the client and reviewed the case with him. He provided copies of all his invoices. European import laws are different from US laws. With European accounts, Amazon typically requests proof that sellers are importing their products from within the European Union; this policy is called Parallel Importing. Parallel Importing refers to where you are sourcing your products from. If you are selling in Europe, you are supposed to source your products from Europe; you are not allowed to source your products in the US and then ship them to FBA in Europe. **We are not concerned where you source from, our job is to get your account reinstated. We only use our knowledge of Amazon's policies to help get our sellers reinstated. We help SELLERS…. we do NOT work for Amazon.** Together with the rest of our team, we came up with a strategy and drafted a Plan of Action, sent it to the seller and had him forward the Plan to the Amazon Notice-Dispute team, which works with the Seller Performance team. With the help of one of our attorneys, we got a retraction from the Netgear complaint which helped to get our client's account reinstated. A significant part of our practice focuses on getting IP complaints (Rights Owner Complaints) withdrawn. Sellers who hire us get the benefit of our collaborative team; nothing we do is outsourced. We are available to help sellers 24 hours a day, 5 days a week. When a seller gets an intellectual property complaint, the first thing we do is try to get it withdrawn. Most of these complaints are baseless. We then draft a Plan of Action to send to the Amazon Notice-Dispute department and try to get the complaint retracted. After a few days, we got the account reinstated and our client was back up and selling again. We got reinstated after the first Plan Of Action by working together to help our client.
